Flitto Terms and Conditions

Article 1 (Purpose)

①     Flitto Co., Ltd. (hereinafter referred to as “Company”) makes users of “Service” to request translations, to translate, or to enjoy the translated contents through “Flitto” (hereinafter referred to as “Service”, collectively referred to as the “Flitto Website, Applications, and Services”).

②     These Terms and Conditions are intended to prescribe the rights, obligations, and responsibilities of “Company” and “User”, and other necessary matters related to the use of Flitto and all the services related to Flitto.

Article 2 (Definition)

①     The terms used in these terms and conditions are defined below.

1.      “User” means a user of “Service” who has agreed to these Terms of Use and has completed the User Registration.

2.      "User Name" means a combination of letters, numbers, and special symbols that are designated by the "User" and approved by the "Company" to identify the "User" and use the "Service".

3.      “Password” means a combination of letters, numbers and special symbols that “User” set to confirm that “User” is the “User” who is authorized to use “User Name” in the process of using “Service”, and to protect the secrets of “User” in “Service”.

4.      “Account” means a login account based on “User Name” and “Password”.

5.      "Points" means virtual data in "Services" that "Users" can earn through translation activities or buy through purchase in Flitto, and can be used as a payment method under the criteria set by the Company when using the Services.

6.      “Request” means an act of “User” providing all forms of original text, including texts, photographs, voices, sounds, and various files and links, to Flitto for the results of translation or proofreading.

7.      "Translation" means an act of “User” creating or providing all forms of translation or proofreading, including texts, photographs, voices, sounds, and various files and links to Flitto.

8.      "Translator" means any individual providing services for translating or proofreading the original text in accordance with this Terms of Use.

②     Any part of the terms used in these Terms and Conditions not defined in this Article is subject to the relevant laws and general practices.

Article 3 (Statement, Effect, and Revision of Terms and Conditions)

①     The Company shall post the contents of this Agreement in the designated space within the Service so that the User can easily know.

②     The Company may amend this Agreement to the extent that it does not violate the relevant laws such as the Act on the regulation of the Agreement, Act of the Promotion of the Use of Information and Communication Networks and the Protection of Information.

③     When the Company revises the Terms and Conditions, the date of application of the amended Terms and Conditions and the reason for the amendment shall be specified and notified in the designated space within the Service from 7 days before the date of application to the day before the date of application. However, if the revision is unfavorable to the User, the notice will be given at least 30 days grace period.

④     Although the Company clearly informs the User of the amendment of the Terms in accordance with the preceding paragraph and clearly indicates that he/she shall approve the failure to express his/her refusal until 7 days after the effective date of the amended Terms and Conditions, Company will assume that the User have agreed to the changed terms if the User does not expressly disapprove.

⑤     If the User does not agree with the revised agreement, the User may terminate the use agreement. If the existing agreement cannot be applied, the “Company” may also terminate the use agreement.

Article 4 (Interpretation of Terms)

①     The Company may have separate terms and conditions (hereinafter referred to as “Individual Terms”) for individual services such as “Store”. If the contents of the Individual Terms conflict with these Terms and Conditions, these Terms and Conditions shall take precedence.

②     Any matters not specified in these Terms and Conditions or interpretation of this agreement shall be in accordance with the “Individual Terms” and related laws, and in the cases not specified in the law, practices or customs will follow.

Article 5 (Sign Up)

①     A person who intends to use the "Service" (hereinafter referred to as "Applicant") shall subscribe to the "Service", and apply for subscription by checking the checkbox indicating that the "Applicant" agrees to the terms and conditions. Membership is established by the Company's acceptance of the application of the “Applicant”. In this case, the applicant will be deemed to have agreed to the following.

1.      The “Applicant” is an individual who is 14 years of age or older.

2.      Agree to these Terms and Conditions.

3.      Recognize and agree that sanctions may be taken in violation of these Terms and Conditions.

②     People under 14 years of age cannot use the “Service”.

③     The “Company” may, if deemed necessary, have the applicant submit a separate document for joining.

④     In the following cases, the “Company” may or may not withhold the acceptance of the subscription, or may terminate the use contract afterwards.

1.      If a "User" whose violations or causes attributable to violations of the terms and conditions resulted in warnings, suspension from services, or permanent withdrawal from services by the "Company" subscribes to the service again within 6 months after service withdrawal or contract cancellation.

2.      If the “User” who has withdrawn under these Terms and Conditions has applied for the same email address again within 30 days.

3.      If false information is entered in the application form or the information provided by the Company is not entered

4.      Application is not possible due to the fault of the “Applicant” or “User” or in violation of other regulations

5.      Other cases where the "Company" clearly acknowledges that it may be harmful to other "Users" or contrary to social order and morals based on relevant laws and regulations.

6.      "Applicant" or "User" is under 14 years old

7.       If a "User" who withdrew from the service in accordance with the terms and conditions subsequently filed an application of admission within 30 days to a service within the platform using the same telephone number

⑤     The “Company” may withhold approval if there is no room for service-related facilities, or if there is a technical or business problem in providing the service, or if the “Company” deems financially or technically necessary.

⑥     If the acceptance of subscription is suspended in accordance with Paragraph 4, the “Company” may notify the email address entered by the “Applicant” when the “Company” is deemed necessary.

⑦     The date of establishment of the use contract shall be the time when the “Company” marked the completion of the subscription in the application process.

⑧     The “Company” can give a grade to “User” according to company policy, and can differentiate the grade according to the use of service.

Article 6 (Change of User Information)

①     The “User” can access his / her user information at any time through the settings and My Page menu, etc., and can modify the information by inputting on the page or requesting the “Company”.

②     If the “User” changes the information specified in the subscription application, he / she shall inform the “Company” of the change, and the “Company” shall not be responsible for any disadvantages caused by not notifying the “Company” of the change.

③     The “User” shall notify the “Company” without delay or register the change by changing his / her personal information without delay if any matters specified in the application for registration, such as contact means (e-mail, mobile phone number), are changed. The “Company” shall not be liable for any damage caused.

Article 7 (Collection and Protection of Personal Information)

①     The “Company” collects the personal information necessary from the user to provide the service.

②     To the personal information collected under Paragraph 1, the “Company” shall endeavor to protect the personal information of the “User”. Regarding the protection and use of personal information, relevant laws and the company's personal information processing policy.

③     Personal information processing policy of the “Company” does not apply to linked sites other than the official service of the “Company”.

Article 8 (Responsibility for Managing “User Name”, etc.)

①     The "User" is responsible for the management of "User Name" and "Password" of the "User", and the “User” is responsible for all disadvantages if the third party uses it due to the “User”'s intention or negligence.

②     When the “User” recognizes that the “User Name”, “Password” and additional information are stolen or used by a third party, he / she shall immediately notify the “Company” and follow the instructions of the “Company”.

③     In the case of Paragraph 2, the “Company” shall not be responsible for any disadvantages caused by not notifying the “Company” or not following the instructions of the “Company” even if notification of the “User” to the “Company” exists.

④     The “Company” can restrict the use of the “User Name” when the "User Name" of the "User" is concerned with the leakage of personal information, contradicts antisocial or morals, or maybe mistaken as the "Company" or the “Company”'s Operator.

Article 9 (Use of Service)

①     The “Service” provided by the “Company” is as follows.

1.      Collective Intelligence / Crowdsourcing Translation Service

2.      Translation brokerage services

3.      Translation contents provision service

4.      Store service

5.      Any other services provided by the "Company" to the "User" through further development or partnership agreements with other companies.

②     “Service” can be used immediately after the "Company" approval. However, if you do not complete email verification, there may be restrictions on the use of some or all of the Services.

③     Requests, translations, memos, comments, self-introductions, contents, etc. posted by the “User” on the service will be posted in a form that can be disclosed to an unspecified number of people. Are not deleted except in exceptional cases.

④     The “Service” usage time shall be in principle 24 hours a day, 7 days a week (00: 00-24: 00) except when the “Company” cannot provide the service for technical or business reasons.

⑤     The “Company” may temporarily suspend the provision of services if there are significant reasons for its operation, such as regular inspection, replacement and failure of service facilities, or loss of communication. If the interruption of service provision exceeds 24 hours, the Company will notify the “User” in advance according to Article 10. If there is an unavoidable reason that cannot be notified in advance, it will be notified after the fact.

⑥     The “Company” may conduct regular inspection when it is deemed necessary to provide the “Service”, and the regular inspection time will be announced through the service provision screen.

⑦     The “User”'s right to use the service may not be transferred, given or used for a pledge.

⑧     If it is judged that the use of the service by the “User” is not done according to the normal procedure, the “Company” may intervene and take over the actions of the “User”. At this time, the judgment is entirely up to the “Company”.

Article 10 (Notice to the User)

①     If the “Company” notifies the “User”, it can be done by e-mail of the user registered in the “Service” unless otherwise specified in this agreement.

②     In the case of Paragraph 1, the “Company” shall not be responsible if the “User” does not receive e-mail authentication or if he/she inputs false e-mail intentionally or by mistake.

③     In case of notification to the whole “User”, the “Company” may substitute the notice of Paragraph 1 by issuing news in the “Service” or posting it on the notice board for 7 days or more.

Article 11 (Changes in Services)

①     The “Company” may change or terminate all or part of the “Service” provided by operation and technical needs if there is a considerable reason.

②     If the contents of the “Service” are changed or terminated under Paragraph 1, the “Company” shall notify the “User” of the registered e-mail address of the change or termination of the contents of the “Service”. However, if the change or termination of the service affects the entire “User” or an unspecified number of people, the “Company” can notify the “Users” by publishing news in the “Service” or posting on the notice board.

③     The “Company” may modify, suspend, change, or terminate some or all of the “Services” provided free of charge according to the “Company”'s policies and operations and will not provide a separate compensation to the “User” unless otherwise provided in the relevant laws..

④     If the paid “Service” is terminated, the “Company” must notify the “User” who uses the “Service” under the provisions of Paragraph 2 and refund it.

Article 12 (Restrictions and Suspension of Service Use)

①     The “Company” may take measures such as warning, restriction of the use of the “Service”, suspension of the use of the “Service”, or permanent withdrawal of the “Service” when it is determined or occurred that any of the followings occur. In the event of damages to the “Company”, the points corresponding to the damages can be collected.

1.      The "User" intentionally or negligently interferes with the normal operation of the “Company”'s services.

2.      The "User" has violated the obligations of Article 14.

3.      In the case of criminal acts such as identity theft and payment theft, illegal communication and hacking, distribution of malicious programs, and excess access rights

4.      If it is deemed inappropriate for the “Company” to continue providing services for other reasons.

②     The right to judge violations of Paragraph 1 lies entirely with the “Company”. When the use is suspended, all benefits except points acquired through the use of the “Service” will be destroyed, and the “Company” will not compensate for it.

③     The "Company" may restrict the use of the "Service" of the "User" for the protection of user information and the efficiency of operation if the "User" has not logged in for more than 3 months. In this case, the “User” can use the “Service” again by applying for resumption of the “Service” use to the “Company”.

④     If “Company” decides to take sanctions against the “User” under Paragraph 1, “Company” can immediately implement this and notify it to the e-mail address registered in “Company”. The User may appeal to the Company via e-mail within 7 days of receiving notice of the Company. If the Company agrees that the objection is justified, the Company will immediately resume the use of the Services, and the benefits will be reinstated.

⑤     The “User” or the third party who has been infringed by privacy, defamation, or copyright infringement by other “Users” posts can request the “Company” to delete the posts and to sanction the relevant “User” by disclosing the infringement. In this case, the “Company” may take action on the post or the “User” at the “Company”'s own discretion.

⑥     The “Company” may blind(obscure), delete the post, or sanction the “User” when the “Company” admit that the posts or etc. that posted in the “Service” infringe on the rights of third parties such as privacy infringement, defamation or copyright infringement, or interfere with the use of the “Service” of other “Users” and in the event of a loss of reputation, or there is a significant reason that the post should not be posted, even if there is no report.

⑦     In the event that another "User" or a third party take civil or criminal legal action against the "User" or the "Company" on the basis of infringement of legal interests due to the posting of the "User", etc., the "Company" may provisionally restrict access to related posts, etc. until the court decision is final. The responsibility of the explanation of the legal action related to the restriction of access to the posts, the explanation of final judgment of the court, etc. shall be borne by the person requesting for action on the posts, etc.

Article 13 (Obligations of the Company)

①     The “Company” does not do prohibited acts contrary to the law and this agreement or public order and morals, and endeavors to provide continuous and stable service.

②     The "Company" shall endeavor to protect the personal information of the “User”, which has been got in the process of providing “Service”, without leaking or distributing it to a third party without their consent.

③     The "Company" shall have a security system to protect personal information (including credit information) so that the “User” can use the “Service” safely, announce and comply with the Privacy Policy.

④     The "Company" shall immediately deal with any opinions or complaints raised by the "User" regarding the use of the "Service" if the "Company" concedes the opinion or complaint is reasonable. In the case of comments or complaints raised by the "User", the process and results shall be communicated to the User.

Article 14 (Obligations of the User)

①     ① The User shall not act in any of the following.

1.      Provide false information when applying for subscription or changing the “user” information

2.      Theft of others' information

3.      Change the information posted on the "Service" of the "Company" or use the information obtained by using the "Service" for reproduction, publication, broadcasting, etc. for commercial or non-profit purposes or offer to third parties without the prior consent of the "Company".

4.      Receive money or transfer the right to use the Services or receive money in return by providing a third party with the opportunity to promote the "User" or promoting a third party on behalf of a third party using the "Services" provided by the "Company".

5.      Infringe on the rights of the "Company" or third parties, such as posting false facts about the "Company" or other third parties, or infringing on intellectual property rights.

6.      Use unfairly the "Service" by stealing the "User" and "Password" of other "Users".

7.      Use the company's paid services using payment information of others without the permission of others, such as account numbers and credit card numbers of others.

8.      Post any content that suggests joining a pyramid or terrorist organization or post obscene or violent messages, postings or voices, or disclose or posting information that is against public order or morals.

9.      Transmit or post information (computer program, etc.) that is prohibited from being transmitted or posted by related laws such as the Information and Communication Network Act.

10.   Post of harmful media for juveniles under the Juvenile Protection Act

11.   Disseminate of information, sentences, figures, sounds, etc., in violation of public order or morals

12.   Post or send messages by pretending or impersonating an employee of the Company or a manager of the Services or by using the name of another person.

13.   Post or e-mail any materials containing software viruses or other computer codes, files or programs designed to disrupt or destroy the normal operation of computer software, hardware or telecommunications equipment.

14.   Interfere with other “Users”' use of the "Service", such as stalking, abusive language, or plastering.

15.   Collect, store or disclose the personal information of other “Users” without their consent.

16.   Collect information from other “Users” to post advertisements or propaganda or send spam mails to an unspecified majority;

17.   Modify, reverse engineer, decompile, or disassemble software provided by the "Company".

18.   Use the "Company"'s intellectual property without permission, including the "Service" description or terms and conditions of the "Company", without the "Company"'s consent.

19.   Provide information in the "Services" to competitors or potential competitors of the "Company";

20.   Provide incorrect translations, including intentional or repeated use of automatic translators.

21.   Provide inaccurate translations for rewards such as points or badges.

22.   Access to information that is not open to “Users”, such as server computer of the “Company”

23.   Attempt an individual transaction other than the "Service" which is not agreed with the "Company" in advance by exposing personal information or exposing personal contacts.

24.   Violate current laws, terms and conditions set forth in the "Services" provided by the "Company", and other regulations regarding the use of the "Services".

25.   Interfere with any other "User"'s use of the "Services" or the provision of the "Services" by the "Company".

26.   Act actions other than above that may be harmful to the “Company” and the "Services"

②     The "User" should comply with the related laws, the provisions of this Agreement, the precautions noticed related to information of use, and "Service", and the notices of the "Company", and should not act in any way that interferes with the work of the "Company". If the "User" acts in violation of Paragraph 1 or Paragraph 2, the "Company" may delete or temporarily delete the postings, may restrict the use of the "Service", may terminate the contract, may permanently delete the account, may take legal action such as civil sue or criminal charge. If the damage occurs to the "Company", you can claim for damages or collect points corresponding to the damages.

Article 15 (Copyright of Posts)

①     The “Company” does not require the “User” to request the copyrighted work or personal information of a third party, including the “User” or original author, in the process of receiving data according to Article 3 from the “User”, and has no obligation to examine whether there is any copyrighted work or personal information in the data provided by “user”.

②     The "Company" does not know that it is a copyrighted work or personal information even if the "User" includes the copyrighted work or personal information of the "User" or a third party for any reason in the data, and even if the original text, translation, and corpus data contain and store the copyrighted work or personal information of the “User” or third party by accident or by the "User"'s intention, it is not due to the intention and negligence of the “Company”.

③     If there is a copyrighted work of the "User" in the original text provided by the "User", it is deemed that the "User" allowed the "Company" to use for profit for the commercial part, such as making a translation by the "Company" or granting a license to a third party.

④     If the "User" enters the copyrighted work or personal information of the "User" or a third party for any reason in the original text provided by the "User" for translation, it is not deemed that the "Company" copies such copyrighted work or collects personal information.

⑤     If the "Company" finds suspected personal information in the data, it may modify or delete it arbitrarily regardless of the personality of the relevant part, but it is not that the "Company" takes responsibility for personal information that exists in the original text provided by the "User".

⑥     When providing data(including original text modified according to clause 2, same below) for the “Company”, the "User” shall accept that the “Company” can use it to create translations or grant a license that can issue a sub license to a third party, or duplicate, distribute, perform, exhibit, or display it for the economical benefits of the “Company” as long as it does not unfairly interfere with the rights of the “use”.

⑦     The “Company” acquires copyrights, author's property rights and author's moral rights of all translations and corpus (original and translation pairs) generated through the "Service".

⑧     The “User” may delete the work or personal information existing in the original text provided by “User” and delete it and provide it to “Company” again.

⑨     The “User” must indemnify the “Company” at the expense of the “User” when a legal problem occurs, such as when the “Company” is sued for copyrighted work or personal information contained in the data provided by the “User” to the “Company”.

Article 16 (attribution of rights)

①     Copyright and intellectual property rights of the "Service" belong to the "Company". However, this excludes posts and copyrighted works provided under an affiliate agreement.

②     The “Company” grants the “User” only the right to use Account, “User Name”, Content, “Point”, etc. in connection with “Service” according to the terms and conditions set by “Company”, the "User" is not allowed to transfer, to sell, or to provide collateral the right to use.

Article 17 (points)

①     “Company” can give “Point” to the "User" in the process of using “Service” such as translation, event(promotion).

②     The “User” may use the “Point” alone or with other payment methods when using the “Service” in accordance with the procedures and conditions prescribed by the “Company”.

③     Details of the grant and use of the “Points” shall be in accordance with the policies separately set by the “Company” and the “Company” shall notify the “User” through the website operated by the “Company”.

④     Depending on the “Company”, some “Points” may be limited in scope.

⑤     The "User" may use the "Points" only for his or her use of the "Services", and may not sell or transfer the "Points" to others under any circumstances.

⑥     If the “User” has acquired “Points” unfairly or illegally, the User cannot use the Points and the “Company” may collect(withdraw) it.

⑦     The “Company” may adjust some or all of the “Points” after the prior notice for efficient use and operation of the “Services”, in case of any fault for the “User” such as Article 14 violation, the "Company" can adjust some or all of the “Points” without prior notice.

⑧     "Points" have a valid period of up to 5 years (60 months) from the month you purchase or earn them, and they may be used within the period.

⑨     "Points" that the valid period is expired shall be automatically discarded under the basis of first-received, first-discarded.

⑩     Under circumstances that "User" and "Company" mutually terminate the user agreement, and that "Company" completes membership withdrawal process when "User" displays an intention of it, "Points" are immediately discarded. When a user signs up for the "Service" again, "Points" shall not be recovered.

Article 18 (Refund of Points)

①     In the event of an over or mistaken paid by the “User”, the “Company” will refund the amount corresponding to the “Point”. In such a case, the fee incurred as a result of the refund procedure shall be borne by the User.

②     In case of a refund of “Points” due to the responsibility of the "User", such as change of mind, the method is as follows.

1.      Refunds of “Points” can only be refunded in the minimum transaction unit of “Points” presented by the Company on the Store. If the balance of the “Points” remaining after use is less than the minimum trading unit, the “Company” shall not be required to refund.

2.      The "User" shall be responsible for any fees incurred due to the refund process.

③     Notwithstanding the provisions of Paragraph 2, the following items will be refunded in full:

1.      If the "User" has not used the "Service" after completing the payment

2.      If the "Service" is not available due to the "Company" fault, such as "Service" failure

3.      In case of refund for reasons 1, the "User" shall be responsible for the fees incurred. In the case of a refund for reasons 2, the “Company” shall bear the fee incurred.

④     If the "User" violates the provisions of Article 14 and the "Company" restricts the use of the "Service" by the "User" or unilaterally terminates this Agreement, the "Company" shall not be responsible to refund the "Points" equivalent to the damages incurred by the "User".

⑤     When the "User" terminates the use contract or withdraws the "Service", the "User" must request a refund for the remaining points. If the "User" terminates the use contract or withdraws the service without requesting a refund, the "Company" has no obligation to refund any remaining “Points”.

⑥     If the “Point” of the “User” is mixed with "Points" acquired by purchase and “Points” acquired through activities in the service, the “Points” to be refunded shall be calculated by using the purchased “Points” first.

⑦     Refunds should be made using the payment method used by the “User”, but if this is impossible, the refund shall be made in a separate method determined by the “Company”.

⑧     In principle, the Company shall process the refund process within 7 business days. If a delay occurs due to the delay of processing by a third party such as credit card company, PayPal or the cause of the “User”, the corresponding days are not included in the processing period.

Article 19 (Store)

The use of the store is governed by the ‘Store Terms and Conditions.’

Article 20 (Termination of Use Agreement)

①     The “user” can apply for termination of the use contract at any time through the setting menu on the website or application, and the company shall handle this immediately.

②     If the “User” violates Article 14, the “Company” may unilaterally terminate this Agreement, and if this results in damages to the operation of the Service, the "User" may be subject to civil and criminal liability.

③     If the "User" terminates the User Agreement, the User shall be deemed to have given up all access to the existing translation data and the “Points”.

④     When the “User” terminates the contract, the “Company” encrypts and stores the “User”'s e-mail information, which is not used for the purpose of checking to prevent re-subscription. All data of the “User” is destroyed except the encrypted email information. Provided, however, that in the case of a translation adopted by the requester, a request for which a participating translator exists, or data already processed into a translation pair will be left in the “Service” for continued use of the requester, translator, and the “Company”.

Article 21 (Disclaimer)

①     If the "Company" cannot provide the "Service" for the following reasons, the "Company" shall not be responsible for any damages caused to the "User".

1.      In the event of natural disaster or equivalent force majeure

2.      In case of a failure to use the "Service" due to the fault of the "User";

3.      If there is a deliberate disruption of services by a third party that has entered into a "Service" partnership agreement with the "Company" to provide the "Service";

4.      If the "Company" cannot provide the "Service" due to other DDOS attacks, IDC failure, line service of the telecommunications carrier, or equivalent force majeure.

②     The "Company" does not guarantee the quality or reliability of translation unless otherwise specified and does not guarantee the reliability, accuracy, etc. of information, materials, facts, etc. posted by the User in relation to the Service. Neither is any liability assumed for damages caused by the “User”.

③     The "Company" shall be exempted from liability in the case of transactions through “Service” between each “Users” or between “Users” and third parties.

Article 22 (Governing Law and Jurisdiction)

①     Lawsuits filed between the "Company" and the "User" shall be governed by the laws of the Republic of Korea.

②     For disputes arising between the "Company" and the "User", the Seoul Central District Court of Korea shall have jurisdiction.

Addendum

These Terms are effective from November 21, 2022. However, in the case of new users who subscribed before the effective date after the notification of these Terms, the Terms will apply from the time of user registration.

FLITTO 1: 1 Professional Translation Terms and Conditions

Article 1 (Purpose)

These Terms and Conditions is for the purpose of defining the rights, obligations and responsibilities of the Company, the Translator, the Requestor, and other necessary matters related to the FLITTO 1: 1 Translation Service provided by FLITTO, Inc. (hereinafter referred to as the Company).

Article 2 (Definition)

The definitions used in these Terms and Conditions are as follows.

1.      “FLITTO 1: 1 Professional Translation Service” (hereinafter referred to as “Service”) means a matching service where “Company” connects “Translator” and “Requester” through “Platform”, and the act of translation requests, providing translation and the act accompanying it through the matching service.

2.      “Platform” refers to the space on the Internet where “Requester” and “Translator” are matched, Requester's translation request, Translator's translation and so on.

3.      “Requester” means a user who provides the original text and uses the translation service in accordance with these Terms and Conditions.

4.      “Translator” means a person who provides translation service for the original text in accordance with these Terms and Conditions.

5.      Of the Terms and Conditions used in this agreement, the parts not defined in this article are subject to related laws and general practices.

Article 3 (Clarification, explanation and revision of Terms and Conditions, etc.)

①     The Company shall post the contents of this Agreement in a designated place on the Platform so that the “Translator” and the “Requester” (hereinafter referred to as “User”) can easily understand the contents of this Agreement. In addition, there will be a procedure for the “translator” or the “requester” to view and agree to these Terms and Conditions when using the Services for the first time.

②     The Company may amend these Terms and Conditions in the scope that the Company shall not violate related laws such as the Act on Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Act on the Promotion of Information and Communications Network Utilization and Information Protection, and the Consumer Protection Act.

③     When the Company revises the Terms and Conditions, the date of application of the amended Terms and Conditions and the reason for the amendment shall be specified and notified in the designated space in the “Platform” from 15 days before the date of application to the day before the date of application. However, if the revision is unfavorable to the "user", the notice will be notified for at least 30 days and the existing "user" will be sent to the e-mail address.

④     Although the Company clearly informs the User of the amendment of the Terms and Conditions in accordance with the preceding paragraph and clearly indicates that he/she shall approve if he/she failed to express refusal until 7 days after the effective date of the amended Terms and Conditions, if the User does not expressly disapprove, the Company will assume that the User has agreed to the changed Terms and Conditions.

⑤     If the “User” does not agree with the revised agreement, the “User” may terminate the use agreement and if the existing agreement cannot be applied, the “Company” may also terminate the use agreement.

Article 4 (Interpretation of Terms and Conditions)

①     This Agreement is a sub-term of the “FLITTO Terms and Conditions”. If the contents of this Agreement conflict with “FLITTO Terms and Conditions”, the “FLITTO Terms and Conditions” shall prevail.

②     Matters not specified in these Terms and Conditions or interpretation of these Terms and Conditions shall be governed by the relevant laws and regulations or customs or customs in the parts not specified in the Law.

Article 5 (Use of Service)

①     “Company” provides the following services to users.

1.      Intermediary services linking "translators" and "requesters"

2.      If requested by the translator, the escrow service is provided to the translator upon the completion of the translation service after payment of the translation fee, which is the price of the translation service, from the requester.

②     "Service" can be used immediately after the "Company" 's application for 1: 1 professional translation service.

③     “Requester” can request translation by inputting original text to be translated, setting language and translation fee of original text and translation, and prepaying the translation fee. You can also cancel your payment if you don't have a translator that meets those requirements or a translator who wants to translate the translation request. If a translation request is made in a fraudulent or incomplete manner during this process, the Company may revoke the request and payment by ex officio.

④     After “Translator” is registered as a 1: 1 professional translator. After reviewing the translation request provided by the “Company”, he selects and accepts the translation work for himself to participate in, and provides the sample translation and the final result of translation. You must be diligent in responding to the request of the “Requester” for the outcome. If a translation or payment process is made in an illegal or incomplete manner, the Company may cancel the translation or payment in its sole discretion.

⑤     In principle, the service usage time shall be 24 hours a day, 7 days a week (00: 00-24: 00) except when the Company cannot provide the service for technical or business reasons.

⑥     “Company” may temporarily suspend the provision of services if there are significant reasons for its operation, such as regular inspection, replacement and failure of service facilities, or loss of communication. If the suspension of service is more than 24 hours, the Company will notify the User in advance according to Article 10. If there is an unavoidable reason that cannot be notified in advance, the Company will notify in the future.

⑦     “Company” may conduct regular inspection when it is deemed necessary to provide the service, and the regular inspection time will be announced through the service provision screen.

⑧     The user's right to use the service cannot be transferred or given to it or used for the purpose of pledge.

⑨     If it is determined that the user's use of the service is not done according to the normal procedure, the company may intervene and take over the user's actions. At this time, the judgment is entirely up to the Company.

Article 6 (Copyright and Confidentiality Obligations)

①     The copyright of the original text belongs to the “Requester”, and if the “Requester” is not the copyright holder, the “Requester” is responsible for any problems caused by this. The Company has comprehensive permission that can reproduce, distribute, exhibit, perform, or create, reproduce, distribute, exhibit, or perform secondary work on a translation pair consisting of a combination of translated original texts and translations formed during the provision of the Services.

②     The copyright of the translation is owned by the translator, and if the translator is not the copyright holder, the translator is responsible for any problems arising from it. The Company has comprehensive permission that can reproduce, distribute, exhibit, perform, or create, reproduce, distribute, exhibit, or perform secondary work on a translation pair consisting of a combination of translated original texts and translations formed during the provision of the Services.

③     “Translator” has the duty to keep the original translation request text and the contents of the translations confidential, regardless of whether the translation request is accepted or not.

④     If the "Requester" and "Translator" cause damages to third parties such as "Company" and "Copyright holder" because they are not the copyright holders for the original text and translations, the "Requester" and "Translator" shall be liable for compensation and have responsibility to indemnify third parties for any such damages.

Article 7 (Duties and Responsibilities of Translators)

①     If the Requestor sets up a sample translation upon initial translation request, the “Translator” 's acceptance of the work means that he / she also accepted the sample translation. This also means that if you decline a sample translation, your translation request may be cancelled. In addition, accepting a sample translation means that you may cancel the translation request at the request of the “Requester” when providing a sample translation.

②     If the “Requester” makes a request for correction of the final translation result, the “Translator” shall respond as faithfully as possible. If the requester cannot fulfill the intended purpose as a result of the translation because he has not responded to the request for correction, the requester may cancel the translation request.

③     In the process of “translation” paid by the “translator” to the “translator”, the “translator” pays various fees and expenses paid to a third party other than the “company” for reasons of currency exchange and withdrawal. If there is problem related to it, the problem should be resolved by a “translator” with a third party.

④     The Company may disqualify the Translator from using 1: 1 professional translation service at any time.

⑤     Payment may not be made even upon approval in case of any violation of the Company's Terms of Use or regulations stipulated for translators in the overall process of translation. Civil actions such as requests for refund of payment in addition to criminal charges including tortious interference or fraud may be taken against abusive users.

Article 8 (Obligations and Responsibilities of Requester)

①     “Requester” should review the sample translation result within the designated time when it is registered in the system. If the cancellation request is not entered into the service by the time elapsed, the result of the mid-term inspection will be deemed to be accepted and after that the translation cannot be cancelled.

②     “Requester” shall review the final translation result within the designated time when it is registered in the system. If you do not decide whether to finalize your deliverables by that time, you will be considered final.

Article 9   (Settlement of Disputes)

①     In case of any dispute between the “Requester” and the “Translator” regarding the results of the translation, the “Company” shall have the priority of arbitration. If the dispute is not resolved despite the Company's arbitration efforts, it will be settled in accordance with applicable laws.

②     For disputes arising between “Company” and “Translator” or “Company” and “Requester”, it shall be the governing court of Seoul Central District Court of Korea under the laws of Korea.

Appendix

These Terms and Conditions will apply from October 25, 2019. However, in the case of new users who subscribed before the effective date after the notification of these Terms and Conditions, the Terms and Conditions will apply from the time of user registration.

Terms and Conditions of Flitto Location Information Service

Article 1   (Purpose)

①     The terms and conditions aim to define the rights, obligations and responsibilities of the Company and the subjects of personal location information as well as other required matters with regard to location information business or location-based services provided by Flitto(“The Company” hereinafter).

The Company collects location information based on GPS information collected through terminals equipped with GPS functions, Wi-Fi information collected through terminals equipped with Wi-Fi functions, real-time base-station (Cell ID) location information collected through mobile terminals and location information API provided by a electronic terminal operating system (OS) including smartphones and tablet PCs.

Article 6   (Rights of Subjects of Personal Location Information)

①     The Company shall collect, use and share location information in accordance with the Privacy Policy (www.flitto.com)

②     Subjects of personal location information may reserve their agreement to the scope of collection, use and purpose of the provision of location information, the scope of the recipients of location information and some of the location-based services through the direct modification of location-based services.

③     If it is requested by subjects of personal location information, the Company shall take measures immediately to destroy collected personal location information and related records on use. 

④     Subjects of personal location information shall be allowed to withdraw their agreement for the collection, use and provision of location information or part thereof at any time through the direct modification of the environmental setup of terminals.

⑤     Subjects of personal location information may request the Company allow them to read the following materials or inform them, and if there are errors in the materials, they shall be allowed to request correction. In that case, the Company shall not reject the request for no good reason.

1.      Materials verifying the collection, use and provision of personal location information with regard to subjects of personal location information

2.      Reasons for and the contents of provision of personal location information to a third party in accordance with the Act on the Protection, Use, etc, of Location Information or other laws and regulations

⑥     Subjects of personal location information shall temporarily request the Company to stop collecting, using or providing personal location information at any time, and the Company shall not be allowed to refuse the request and shall be equipped with the technology to follow through with it.

Article 7   (Basis for the Preservation of Materials Verifying the Use and Provision of Location Information and Preservation Period)

The Company shall automatically record and preserve materials verifying collection, use and provision of location information with regard to subjects of personal location information in accordance with Article 16-2 of Act on the Protection, Use, etc, of Location Information and keep them for six months. If subjects of personal location information withdraw their entire agreement to use or the provision of personal location information or part thereof, the Company shall immediately destroy data related to use and provision of location information, except when they need to be preserved according to laws. However, if the agreement is partially withdrawn, related parts shall be destroyed, provided that if pertinent location information is included in postings by subjects of personal location information, it shall be preserved as long as the postings are maintained unless elimination is requested.

Article 8   (Modification and Suspension of Services)

①     If it is impossible to maintain services due to corporate conditions such as changes in policy on the part of a location information service provider or due to legal problems, the Company shall be allowed to restrict, modify or suspend the entire services or part thereof.

②     If the service is suspended as seen above, the Company shall release a notification on the Internet in advance or inform subjects of personal location information.

Article 9   (Immediate Notification at the time of the Provision of Personal Location Information to a Third Party)

①     The Company shall not be allowed to provide personal location information to a third party without consent from subjects of personal location information.

②     If the Company provides a third party provision service, the recipient and the time and purpose of the provision of service shall be notified to subjects of personal location information to receive approval.

③     If the Company provides location service to a third party in accordance with the Act on the Protection, Use, etc, of Location Information, it shall have subjects of personal location information choose between whether to be immediately notified or whether to be collectively notified and make a notification as desired.

④     Subjects of personal location information shall be allowed to make requests for review, notification and correction with regard to the reasons and contents of location information provided to a third party.

Article 10 (Compensation for Damage)

①     With regard to the location information business and the provision of location-based services offered by the Company, if subjects of personal location information sustain damage due to the violation of provisions specified in Article 15 or Article 26 of the Act on the Protection, Use, etc, of Location Information, they shall be allowed to request the Company to pay compensation. In that case, the Company shall not be exempt from responsibility unless it proves that the losses were not caused by its intention or negligence.

②     If subjects of personal location information violate the provisions to cause damage to the Company, then the latter shall be allowed to request the former to pay compensation.

③     If subjects of personal location information violate the terms and conditions by conducting illegal activities intentionally or negligently and if it led a third party other than subjects of personal location information to request the Company to make compensation, the subjects of personal location information shall pay for the damage caused to the Company.

Article 11 (Settlement of Disputes)

①     If the Company fails to or is unable to conduct consultations with subjects of personal location information with regard to disputes related to location information, it shall be allowed to request the Korea Communication Commission to make adjudications.

②     If the company and subjects of personal location information fail to or are unable to conduct consultation with regard to disputes related to location information, they shall be allowed to request the Personal Information Dispute Mediation Committee to make adjudications in accordance with the Personal Information Protection Law.

Article 12 (Information on the Company and Personnel in Charge of Managing Location Information)

The Company shall designate the head of a department in charge of providing location based services as the Location Information Manager so that location information can be properly managed and protected and complaints lodged by subjects of personal location information can be smoothly resolved. Article 13 (A Legal Representative’s Right)

If the Company collects, uses or provides location information with regard to subjects of personal location information who are younger than 14 years old, it shall obtain consent from a legal representative in accordance with Articles 18-1 and 19-2 and 19-2 and 21 of Act on the Protection, Use, etc, of Location Information. In that case, a legal representative shall have all rights of subjects of personal location information in accordance with Article 6 of the Act.

Article 14 (Rights of a Guardian of a Child Aged 8 or Less)

①     If a guardian of a person pertaining to each of the following (“A Child Aged 8 or Less” hereinafter) agrees to the collection, use or provision of personal location information on a child aged 8 or less for the purpose of protection of his or her life or body, the Company shall considers that the child agreed to them.

1.      A child aged 8 or less

2.      A ward

3.      A person with mental disabilities specified in Article 2-2-2 of the Persons with Disabilities Act who is regarded as a person with severe disabilities in accordance with Article 2-2 of the Act on the Acceleration of Employment of the Disabled and Occupation Rehabilitation (It is confined to those registered as a person with disabilities in accordance with Article 32 of the Persons with Disabilities Act)

②     A guardian of a child aged 8 or less specified in Paragraph ① refers to a protector of a child aged 8 or less who pertains to each of the following.

1.      A legal representative of a child aged 8 or less or a guardian specified in Article 3 of   the Act on the Guardianship of Minors in Protective Facilities

2.      A legal representative of a ward

3.      A legal representative of a person specified in Paragraph ① - 3, the head of facilities for the disabled specified in Article 58-1-1 of the Persons with Disabilities Act (It shall be confined to facilities installed and operated by the government or local governments), the head of social rehabilitation centers for the mentally disabled specified in Article 3-4 of the Mental Health Act (It shall be confined to facilities installed and operated by the government or local governments) and the head of mental healthcare facilities specified in Article 3-5 of the Mental Health Act

③     If a guardian agrees to Paragraph ①, he or she shall attach documents evidencing guardianship to a signed consent before submission.

④     Article 6 (Rights of Subjects to Personal Location Information) shall apply mutatis mutandis if a guardian agrees to them in accordance with Paragraph ①. In that case, "subjects to personal location information" shall be regarded as “a person responsible for protective custody or care”.

Article 15 (Exemption from Responsibility)

①     If the Company cannot provide services for reasons of each of the following and it shall not be responsible for losses caused to subjects of personal location information.

1.      If it pertains to a natural disaster or uncontrollable circumstances

2.      If a third party that formed a service partnership with the Company for the purpose of the provision of services intentionally interrupted services

3.      If there are problems in using services due to faults on the part of subjects of personal location information

4.      If it does not pertain to the intention or faults on the part of the Company except for provisions specified in 1 and 3 above

②     The Company shall not guarantee the reliability and accuracy of services and information, materials and facts posted on the services and take responsibility for resultant losses caused by subjects of personal location information.

Additional Clause

The terms and conditions shall take effect on October 25, 2019, provided that, notwithstanding the preceding provisions, they shall apply to new members who subscribed prior to the effective date after notification of the terms and conditions from the date of subscription.

The data subject has the right (delete right) to request the deletion of personal information related to him.

    1. FLITTO shall provide information to the data subject upon request of the data subject without undue delay and shall provide the information movement related information taken by the FLITTO within one month after receipt of the application for information movement. If the requested information is complicated and takes some time, FLITTO will notify you of the reason for the extension and the extension period (two months extension, up to three months in total) within one month.
    2. If FLITTO does not take any action on the data subject's application, the data subject may, without delay, request judicial relief from the cause and the oversight body for not taking action within one month of the application date.
    3. The transfer of information is provided free of charge.
    4. The data subject may receive personal information provided to FLITTO directly, or may apply to provide it directly to another controller if technically possible.
    5. FLITTO provides personal information in a "structured, generally widely used, machine-readable format" when a request is made to transfer information from a data subject.

Report and Notification of Personal Information Leakage

FLITTO will report to the supervisory authority within 72 hours of becoming aware of a breach if any of the following infringements occur that could pose a risk to an individual's rights and freedoms:

  2. Reputation damage
  3. Financial loss
  4. Secret leakage
  5. Other significant economic and social disadvantage risks

When there is a high risk of the freedom and rights of the data subject, the data subject is notified without delay.

Article 1 (Purpose)

① Flitto Menu Translation by Flitto Inc. (hereinafter "the Company") refers to the mobile multilingual menu website that was created and is provided by Flitto in response to creation requests by users and the application for such creation requests (hereafter "the Service"). 

② The purpose of these terms of use is to stipulate the rights, duties, and responsibilities of the Company and User with respect to using Flitto Menu Translation, and other necessary matters.

Article 2 (Definitions)

① The definition of terms that are used in these terms of use is as follows.

  1. "User" refers to Service users who agreed to these terms of use and completed user registration.
  2. "ID" refers to a combination of alphanumeric characters and special symbols that are selected by the User and approved by the Company to identify the User and use the Service.
  3. "Password" refers to a combination of alphanumeric characters and special symbols that are selected by the User in order to protect their secrets on the Service, and to confirm that they are the User with the right to use the ID during the process of using the Service.
  4. "Account" refers to the login account based on the ID and password.

② Parts that are not specified in the terms that are used in these terms of use shall be in accordance with relevant laws and general customs.

Article 3 (Stipulation, Effects, and Amendment of Terms)

① The company shall post the content of these terms in a designated space in the Service so that it is easily available to the User.

② The Company may amend these terms within a scope that does not violate the Act on the Regulation of Terms and Conditions, Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc., and other applicable laws.

③ If the company amends the terms, they shall stipulate the amended terms, the effective date of the amended terms, and the reason for the amendment, and announce it in a designated space on the Service 15 days before the effective date alongside the current terms or notify Users via e-mail or push message.

④ If the Company notifies the User of the amendment to the terms in accordance with the previous paragraph, and if the User does not explicitly express their intent to deny the amended terms even though the Company clearly announced that failure to express their intent to deny the amended terms from the announcement date until 7 days after the effective date of the amended terms shall imply their consent to the amended terms, this shall be seen as the User's consent to the changed terms.

⑤ If the User does not consent to the amended terms, the User may cancel the user agreement. In situations where the previous terms are no longer applicable, the Company may also cancel the user agreement.

Article 4 (Interpretation of Terms)

The interpretation of these terms and matters that are no stipulated in these terms shall be in accordance with separate terms and applicable laws, and matters that are not specified in the law shall follow general customs or conventions.

Article 5 (Registration)

① Those who wish to use the Service (hereinafter "Applicant") must register for the Service, and when the applicant checks the box that indicates their agreement to the content of the terms and applies to register and the Company approves their application, their registration shall be confirmed. In this case, this shall apply that the Applicant agreed to the following matters.

  1. Agreement to these terms of use
  2. Acknowledgment and agreement that disciplinary action may be taken if they are in violation of these terms of use.

② Those who are below 14 years of age cannot use the Service.

③ If it is deemed necessary, the company may have the Applicant submit separate documents for registration.

④ The Company may delay approval or deny the application in the cases in the following subparagraphs, and may cancel the user agreement in the future.

  1. If a User, who the Company previously canceled a contract with due to a violation of these terms, applies to register again
  2. If a User who deleted their account in accordance with these terms applies to register again using the same e-mail address within 30 days
  3. If they wrote false information in the registration form or if they did not write down the information that was prompted by the Company
  4. If approval is not possible due to reasons that are attributable to the Applicant or User or if they apply in violation of other regulations
  5. If the Company acknowledges concerns that the Applicant's registration will clearly cause harm to other Users or social order or general customs based on applicable laws
  6. If the Applicant or User is under 14 years of age

⑤ If there is a shortage of capacity in the service-related facility or if there are technical or operational issues with respect to providing the services, or other cases where the Company acknowledges financial or technical needs, the Company may defer approval of the application.

⑥ If the application is deferred in accordance with Paragraph 4 and it is acknowledged by the Company as necessary, the Company may notify the Applicant via the e-mail address they entered.

⑦ When the Company indicates that registration is completed in the registration process, this shall be the point in time when the user agreement is established.

Article 6 (User Information Change)

① The User may view their user information at any time through the settings menu, and they can input information on this page or revise their information by making a request to the Company.

② If the User changes the information that was written when they were applying to register, they must notify the Company of the changes. The Company shall not be liable for any disadvantages that are experienced by the User for failure to notify the Company of the changes, except in cases where the Company was aware of the changes in advance or was not aware due to gross negligence.

③ If there are any changes to the information that was written when the User was applying to register, such as their contact information (e-mail), etc., the User must immediately notify the Company or register the change by changing their personal information. The Company shall not be liable for any disadvantages that are experienced by the User for failure to update their information, except in cases where the Company was aware of the changes in advance or was not aware due to gross negligence. 

Article 7 (Personal Information Collection and Protection)

① The Company collects required personal information from users in order to provide services.

② Regarding the personal information that is collected in accordance with Paragraph 1, the Company makes the effort to protect the User's personal information. Relevant laws and the company's privacy policy are applicable to the protection and use of personal information.

③ However, the Company's privacy policy are not applicable on websites operated by 3rd parties that are linked outside of the Company's official service.

Article 8 (User's Responsibility to Manage Username, Etc.)

① The User is responsible for managing their ID and password. If a 3rd party uses their ID or password due to the User's intent or negligence, the User shall be responsible for all resulting consequences.

② If the User becomes aware that their ID, password, or other information was stolen or is being used by a 3rd party, they shall immediately notify the Company and follow the Company's instructions.

③ In the case of Paragraph 2, if the User fails to notify the Company of the facts or if they fail to follow the Company's instructions after notifying them, the Company shall not be liable for any resulting consequences.

④ If the Company is concerned that the User's ID will reveal their personal information, goes against social order and general customs, or may be confused as the Company or the Company's administrators, the Company may restrict the use of that username.

Article 9 (Service Use)

① The Service that is provided by the Company for Users is as follows.

  1. Multilingual menu website creation service

② The Service may be used as soon as the Company approves the registration application.

③ The store name, store address, main store image, store menu image, content, etc. that is entered by the User on the Service are posted in a way that is visible to many unspecified individuals. Based on the nature of translation services, the content will not be deleted, except in exceptional cases at the Company's discretion.

④ In general, the Service usage time shall be 24 hours per day (00:00 - 24:00), 365 days of the year, except for times when service cannot be provided by the Company due to technical or operational issues.

⑤ The Company may temporarily suspend service provision if there is a significant reason, such as regular maintenance of service equipment, replacement or breakdown, disconnection, or other operational issue. If service suspension exceeds 24 hours, the Company shall notify Users in advance in accordance with Article 10, and if there is an unavoidable reason that renders the Company unable to provide advance notice, they shall notify Users after the fact.

⑥ If the Company may perform regular maintenance if deemed necessary to provide services, and the regular maintenance time shall be announced on the service provision screen.

⑦ The User's right to use service cannot be transferred or gifted or used as a right of pledge.

⑧ If it is determined that the User's service use is not in compliance with normal procedures, the Company may intervene and stand-in for the User. Only the Company has the right to make this decision.

Article 10 (Notifications to Users)

① If the Company sends a notification to Users, they may send it via the User's e-mail address that is registered on the service if there are no other regulations in these terms.

② In the case of Paragraph 1, if the User has not verified their e-mail address or if they were unable to receive the notification because they provided a false e-mail address either intentionally or by negligence, the Company shall not assume liability.

③ For notifications for all Users, the company shall post the announcement on the Service for at least 7 days, and this shall serve as the notification from Paragraph 1.

Article 11 (Service Change)

① The Company may change or discontinue all or a portion of the service that is being provided depending on operational or technical needs if there is a significant reason.

② If the service details are changed or discontinued in accordance with Paragraph 1, the Company shall notify the facts of the service change or discontinuation in advance via the Users' registered e-mail addresses. However, if the service change or discontinuation will affect all Users or many unspecified individuals, the Company may notify Users through an announcement on the Service.

③ The Company may revise, suspend, change, or discontinue all or a portion of the service that is provided for free based on the Company's policies or operational needs, and they shall not compensate Users as long as there are no special regulations in relevant laws regarding this.

④ If the paid service is discontinued, the Company must announce it to Users who use the service in accordance with the regulations of Paragraph 2, and if there is a reasonable usage amount that requires a refund, a refund shall be processed.

Article 12 (Restriction and Suspension of Service Use)

① If the Company deems that the reasons in any of the following subparagraphs will or has happened, they may take action, such as send a warning to the Users, restrict service use, suspend service use, or permanently delete the service account, etc. If the Company suffers damage as a result, the remaining usage amount may not be refunded.

  1. If the User disrupts the Company's normal service operations either intentionally or due to negligence
  2. If the User is in violation of the duties in Article 14
  3. In the event of name theft, payment theft, illegal communication or hacking, distributing malicious programs, act of going beyond access rights, and other illegal activities
  4. Other cases where the Company deems it inappropriate to continue to provide services

② Only the Company has the right to decide on the violations from Paragraph 1. If usage is suspended as a result of this, all Menu Translations in service will be deleted and the Company shall not provide any compensation.

③ If the User does not log in for 3 months or longer, the Company may restrict the User's use of the Service for to protect user information and for more efficient operations. In such cases, the User may use the Service again by requesting to resume Service use to the Company.

④ If the Company decides to take disciplinary action on the User in accordance with Paragraph 1, the Company may take action immediately and a notification shall be sent to the registered e-mail address. The User may subject an objection to the Company via e-mail within 7 days of receiving the Company's notification. If the Company acknowledges that the objection is fair, the Company shall immediately resume Service use and benefits shall be restored.

⑤ Users or 3rd parties who suffered damage, such as invasion of privacy, slander, copyright infringement, etc. due to another User's post may explain the facts of the infringement and request the Company to delete the relevant post and take disciplinary action on the User. In this case, the Company may take action on the relevant post or User based on the Company's overall judgment.

⑥ If the Company acknowledges that a post on the Service infringes upon the rights of a 3rd party, such as invading their privacy, slander, copyright infringement, etc. or disrupts another User's use of the Service, or tarnishes the Company's reputation, or if there is another significant reason why the post must not be posted, the Company may make the post blind, delete the Menu Translation, or take disciplinary action on the User even if there is no report.

⑦ If another User or 3rd party takes legal action on the Company based on an infringement of legal benefits because of a User's content on Menu Translation, the Company may tentatively restrict access to the relevant Menu Translation until there is a definite ruling from the court on the legal action that was taken. The party that requested action shall be responsible for calling for legal action related to restricting access to the Menu Translation and calling for the court's final ruling.

Article 13 (Company's Duties)

① The Company shall not take part in acts that are prohibited by laws and these terms or public order, and shall make the utmost effort to provide continuous and stable services.

② The Company shall not leak or distribute the personal information of Users that was discovered during the process of providing the Service to 3rd parties without the User's permission and shall make the effort to protect this information in accordance with the privacy policy.

③ The Company shall have a security system for protecting personal information (including credit information) so that the User can safely use the Service, and they shall announce and comply with the privacy policy.

④ If the Company acknowledges that a comment or complaint that was brought up by the User regarding Service use is just, the Company shall immediately take action. The Company shall also notify the User of the processing process and results regarding the comment or complain that they brought up.

Article 14 (User's Duties)

① The User shall not partake in the acts in any of the following subparagraphs.

  1. Writing down false information when applying to register or changing User information
  2. Stealing another person's information
  3. Changing information posted on the Company's Service or copying, publishing, broadcasting, or otherwise using the information obtained by using the Service for commercial or non-commercial purposes without the Company's prior consent, or providing this information to 3rd parties
  4. Using the Service provided by the Company to provide 3rd parties with an opportunity to promote the User or performing promotional activities on behalf of a 3rd party to receive money, transferring the right to use the Service or receiving money in exchange for this.
  5. Writing down false information on a 3rd party, infringing upon intellectual property rights, or otherwise infringing upon the rights of the Company or 3rd party
  6. Stealing another User's ID and password to wrongfully use the Service

    7 Using another person's payment information, such as their account number or credit card number, etc. without their permission to use the Company's paid service

  1. Posting content that recommends registering for a pyramid scheme or terrorist organization, posting violent messages, videos, audio, etc., or otherwise sharing or posting information that goes against public order
  2. Transmitting or posting information (computer programs, etc.) that is prohibited from being transmitted or posted in accordance with the Information & Communications Network Act, and other relevant laws.
  3. Posting content harmful to youth as prescribed by the Juvenile Protection Act

    11 Distributing information, sentences, symbols, audio, etc. that violate public order or social customs

    12 Posting or sending messages by falsely acting like the Company's employee or service administrator or using another person's name

    13 Posting information or sending e-mails that include a software virus, other computer code, file, program that was designed for the purpose of disrupting or destroying normal operation of computer software, hardware, electrical communication equipment

    14 Disrupting another User's Service use, such as stalking, cursing, recklessly requesting Menu Translation generation, etc.

    15 Collecting, saving, or disclosing another User's personal information without their consent

    16 Posting advertisements or promotional information to many unspecified individuals or collecting the information of other Users for the purpose of sending spam mail

    17 Modifying the software, etc. that is provided by the Company, engineering the license, decompiling, disassembling, etc.

    18 Stealing the Company's intellectual property, such as the Company's Service description or terms, etc. without the Company's consent

    19 Providing information on the Service to the Company's competitor or potential competitor

    20 Accessing information that is not open to Users, such as the Company's server, etc.

    21 Violating current laws, the terms that are stipulated in the Service that is provided by the Company, and other regulations regarding the use of Service.

    22 Disrupting other another User's Service use or disrupting the Company's Service provision

    23 Other acts that may be detrimental to the Company or Service

② The User must comply with the applicable laws, the regulations of these terms, usage information and precautions that were announced in relation to the Service, and matters that were notified by the Company, and shall not partake in any other acts that disrupt the Company's operations. If the User partakes in any acts that infringe upon Paragraph 1 or Paragraph 2, the Company may delete or temporarily delete the relevant post, and they may take action, such as restricting Service use, canceling the agreement, permanently deleting their account, filing a civil or criminal lawsuit or claim, or they may confiscate the remaining usage amount.

Article 15 (Copyright of Posts)

① In the process of receiving data from Users in accordance with Article 3, the Company does not require personal information or copyrighted works from a User or a 3rd party, including the original creator, from Users, and the Company is not responsible for reviewing whether or not the data that was provided by the User contains copyrighted works or personal information.

② Even if the User includes personal information or works from a User or 3rd party in the data, the Company is not aware of whether or not the data includes copyrighted works or personal information. Even if the User or 3rd party's copyrighted work or personal information is included in the original work, translation, or corpus data either unintentionally or intentionally, this is not a result of the Company's intention or negligence.

③ When the User provides an image, this implies permission for the Company to use it for commercial purposes, such as giving a 3rd party the right to use it.

④ When the User's copyrighted work is included in an image that was provided by the User, this implies permission for the Company to use it for commercial purposes, such as creating a translation for that work, giving a 3rd party the right to use it, etc.

⑤ Even if the User enters personal information or a User or 3rd party's copyrighted work for any reason within the original text that is provided in the request for translation, the Company does not regard this type of copyrighted work or personal information entry as a reproduction of the Company's copyrighted work or personal information collection.

⑥ If the content that may be suspected to be personal information is found in the data, the Company may revise or delete the content regardless of whether or not it actually contains personal information, but this does not imply that the Company is responsible for the personal information that is present in an image that is provided by the user or the original text in the image.

⑦ In general, the Company obtains the copyright, intellectual property rights, and author's moral rights of all translations and corpora (refers to the pair of the original text and translation) that is generated through the Service.

⑧ If copyrighted work or personal information is found in the original text that was provided by the User, the User may delete this in provide it to the Company again.

⑨ If the Company faces a lawsuit or other legal issue because of copyrighted information or personal information that was included in the data that was provided by the User to the Company, the User must indemnify the Company out of pocket.

Article 16 (Attribution of Rights)

① The Company shall own copyrights and other intellectual property rights regarding the Service. However, this excludes copyrighted works, etc. that were provided in accordance with the User's post and partnership agreement.

② The Company only gives the User the right to use their account, Menu Translation, etc. in accordance with the usage conditions that are set forth by the Company regarding the Service. The user cannot transfer or sell this right, use it as collateral, or other acts of disposal.

Article 17 (Payment)

① The Company may charge a regular usage fee for using the Service during the process of when the User creates a Menu Translation or after it is created.

② The Company may provide a regular payment feature so that the User can easily pay for the usage fee.

③ The Company may adjust the usage fee after advance notice for more efficient Service use and operations.

Article 18 (Refunds)

① If the User overpays, the Company shall refund them for the amount. In this case, if there is a fee as a result of the refund procedure, the User shall be responsible for paying this fee.

② If the usage fee is refunded due to reasons attributable to the User, such as if they changed their mind, the process is as follows.

  1. The period in which the actual Menu Translation was serviced shall be pro-rated compared to the period that was paid for, and the usage fee for the remaining period shall be refunded. If the remaining balance is below the minimum transaction volume, the Company shall not be responsible for issuing a refund.
  2. The User shall be responsible for paying the fees that are incurred as a result of the refund process.

③ In the event of the cases in any of the following subparagraphs, the full amount that the User paid for shall be refunded in spite of the regulations in Paragraph 2.

  1. If the Service cannot be used due to fault attributable to the Company, such as a service breakdown, etc.
  2. If a refund is issued due to the reason in Subparagraph 1, the Company shall be responsible for paying the resulting fees.

④ If the Company restricts the User's Service use or unilaterally cancels this agreement because the User is in violation of the regulations of Article 14, the Company shall not refund the User for the amount that corresponds to the resulting damage.

⑤ If the User cancels the user agreement or deletes their Service account, they must request a refund of the remaining usage fee in advance. If they cancel the user agreement or delete their Service account without requesting a refund, the Company shall not be responsible to refunding them for the remaining usage fee.

⑥ In general, refunds shall be processed using the payment method that was used by the User. If this is not possible, the refund shall be issued using a method determined by the Company.

⑦ In general, the Company shall process refunds within 7 business days. If there is a delay from the 3rd party, such as the credit card company, Paypal, etc. or if there is a delay due to fault attributable to the User, the relevant days shall not be included in the processing period.

Article 19 (Canceling the User Agreement)

① The User may request to cancel the user agreement at any time through the settings menu in the application, and the Company shall immediately process this request.

② If the User is in violation of Article 14, the Company may unilaterally cancel this agreement. If this leads to damage to service operations, the User may be held required to take criminal liability.

③ If the User cancels the user agreement, this shall imply that they have forfeited all access rights to existing translation data, images, and remaining usage fees.

④ If the User cancels the agreement, the Company shall encrypt and store the User's e-mail information, and this information shall not be used other than for the purpose of comparing information to prevent re-registration. All of the User's other data aside from the encrypted e-mail information shall be deleted.

Article 20 (Indemnification)

① If the Company is unable to provide the Service for the reasons specified in the following subparagraphs, the Company shall not be liable for any resulting damage incurred to the User.

  1. Natural disaster or other similar cases of force majeure
  2. If there is a problem with Service use due to fault attributable to the User
  3. If there is intentional Service disruption by a 3rd party with a service partnership agreement with the Company to provide Service
  4. Reasons that are not due to the Company's intention or negligence, such as a DDOS attack, IDC defect, wire issue with the key telecommunications business operator, or other cases where service cannot be provided due to other similar cases of force majeure

② Unless otherwise specified in a separate agreement, the Company shall not guarantee the quality or reliability of translations, and the Company shall not guarantee the reliability or accuracy of information, data, or facts posted by Users on the Service. In addition, the Company shall not be held responsible for any damage suffered by the User as a result of this.

③ The Company shall be exempt from responsibility if a transaction occurs between Users or between a User and 3rd party through the Service.

Article 21 (Governing Laws and Court of Jurisdiction)

① The laws of the Republic of Korea shall be the governing laws for lawsuits that are filed between the Company and User.

② The Seoul Central District Court shall be the court of jurisdiction for disputes that occur between the Company and User.

Supplementary Provisions

These terms shall take effect starting January 1, 2021. However, new Users who registered prior to the effective date after the announcement of these terms shall be subject to these terms starting from their User registration date in spite of the previous clause.

Applying to join Flitto Menu Translation (hereinafter "Company") or using the service at the Company implies that you agree to the Flitto Menu Translation terms of use and this privacy policy (collection and use, provision to 3rd parties, etc.). This privacy policy shall always be posted in a designated space in the application, and in the event of any amendments, the changes and the reason for the changes shall be announced through an announcement on the website or e-mail so that users can be aware. The terms used in this privacy policy are identical to the terms of the Flitto Menu Translation terms of use.

1. Personal Information Items for Collection

① The Company collects the following personal information for membership registration, efficient customer service, and to provide various services.

– Required Items: ID, password, e-mail address

– Optional Items: Location information

② The following information may be automatically generated and collected during the process of using the Company's services.

– IP address, visit date and time, service usage records, delinquent usage records, device information, browser type, etc.

③ Additional personal information may be collected, limited to users of this service, during the process of entering an event hosted by the Company, using personalized services, etc., and additional consent shall be obtained in such cases.

④ The following payment information may be collected during the process of paying for usage fees.

– When paying with a credit card: Cardholder's name, card number, payment method, transaction number

– When paying with Paypal: Payment account ID, PayPal transaction number

– When paying with Alipay: Alipay account ID, Alipay transaction number

– When using Google or Apple in-app payments: User identifier, receipt number

2. Purpose of Personal Information Collection and Use

The Company shall only use the collected personal information for the following purposes, and consent shall be obtained in advance in the event of any changes to the purpose.

① Calculation of fees for service provision and fulfilling contracts related to service provision

– Service provision, provision of specific personalized services, identity verification, fee payment, fee collection, etc.

② Member Management

– Identifying registered users, confirming intent to register, prevent wrongful use by delinquent members, taking measures to restrict use by members who violate the terms of use, restricting behaviors that disrupt efficient service operations or wrongful use of service, processing user inquiries and complaints, delivering announcements, saving records to settle disputes, confirm intent to delete account, etc.

③ Development of new services and Use in Marketing/Advertisements

– Develop new services and provide personalized services, provide services and post advertisements based on statistical characteristics, confirm service validity, provide event information and changes to participate, provide advertisement information, assess frequency of access, statistics regarding the member's service use, etc.

3. Personal Information Storage and Usage Period

① In general, the personal information of users are restrictively used starting from when the user registers as a member and for the period in which service is provided. The personal information is immediately discarded once the purpose of collecting and using the personal information is achieved. However, user information that pertains to ② to ④ below shall be saved until the end of the applicable period.

② E-mail address, user's name, IP address, identity verification value, disciplinary action records resulting from wrongful use are encrypted and stored for 6 months even after the user deletes their account in order to prevent wrongful registration, confusion regarding service use, and wrongful use.

③ If an investigation on the violation of applicable laws and regulations  is underway, the ID, password, e-mail address, IP address, cookies, visit date and time, and service usage records are stored until the investigation thereof is concluded. If there is a claim-obligation relationship due to service use, the information shall be stored until the debt is settled.

④ In addition, member information shall be stored for the period of time set forth in applicable laws as follows in accordance with the regulations of relevant laws. In this case, the information stored by the Company shall only use the information for the purpose of being stored. The storage period is as follows.

– Member telecommunication date and time, start/end time, counterpart's member number, usage frequency, transmitter branch location tracking data (Protection of Communications Secrets Act, 1 year)

– Computer communications, Internet log record data, connection point tracking data (Protection of Communications Secrets Act, 3 months)

– Records regarding displays/advertisements (Act on the Consumer Protection in Electronic Commerce, Etc., 6 months)

– Records regarding contract or subscription cancellation (Act on the Consumer Protection in Electronic Commerce, Etc., 5 years)

– Records regarding fee payment and provision of currency, etc. (Act on the Consumer Protection in Electronic Commerce, Etc., 5 years)

– Records regarding processing consumer complaints or disputes (Act on the Consumer Protection in Electronic Commerce, Etc., 3 years)

– Records regarding personal location information (Act on the Protection, Utilization, etc. of Location Information, 6 months)

– Records regarding e-commerce transactions (Electronic Financial Transactions Act, 5 years)

4. Provision of Personal Information to 3rd Parties

① The Company specifies "the 3rd parties that receive personal information, purpose of using personal information, personal information items that are provided, and personal information storage and usage period" for the purpose of providing services to users, and the subjects are limited to users who agree to have their information provided to 3rd parties. If the user does not agree, their personal information shall not be shared with 3rd parties and they shall not be able to purchase products, make payments, or otherwise use the store.

This privacy policy is only applicable to the Company's services. If users access an external website that is provided by a 3rd party through a link during service use, the Company shall not be liable for protecting personal information on the website even if the Company provided the link. Therefore, please review the privacy policy of the external website before using the site.

6. How to Exercise User Rights and Duties

① The user may exercise the following rights regarding personal information protection at any time with the Company.

– Request to view personal information

– Request corrections in the case of an error, etc.

– Request deletion

– Request to stop processing

② Users may request to exercise their rights from Paragraph 1 in accordance with Article 39-7 of the Personal Information Protection Act, and the Company shall take action immediately regarding the request.

③ If the user requests a correction of an error in their personal information or requests to delete their information, the company shall not use or provide the personal information until the correction or deletion is completed.

④ When exercising the rights from Paragraph 1, the user may also exercise their rights through a representative, such as a legal representative or someone with a power of attorney. In this case, they must submit a power of attorney in accordance with Appendix Form No. 11 of the Enforcement Rules to Personal Information Protection Act.

7. Discarding personal information

① If personal information is no longer required, such as when the personal information storage period has passed or if the purpose of processing the information was achieved, the Company shall immediately discard the relevant personal information.

② If personal information must continue to be stored in accordance with other laws even if the personal information storage period that was agreed upon by the user has passed or if the purpose of processing information was achieved, the personal information shall be transferred to a separated database (DB) or stored in a separate storage site.

③ The following is the process and method of discarding personal information.

For personal information that is recorded/stored in an electronic file format, the Company discards the files using a method that makes it impossible to restore the records. ② The user may contact the personal information manager or the department in charge regarding relevant matters, such as questions regarding personal information protection, process complaints, damage relief that may have arised while using the Company's services. The Company shall respond and process the user's inquiries without delay.

9. Measures Taken to Secure the Safety of Personal Information

The Company takes measures to secure safety in accordance with the Personal Information Protection Act, including the following measures in order to secure the safety of personal information.

– Establish and Implement an internal management plan for the safe processing of personal information

– Take measures to control access and restrict access permissions regarding personal information

– Apply encryption technology for safely storing/transmitting personal information or other equivalent measures

– Take measures to prevent storage, forging and modifying access records to prepare against personal information infringement accidents

– Install and update security programs regarding personal information

– Take physical measures, such as installing a lock or setting up a storage facility to safely store personal information

10. Changes to the Privacy Policy

Location Information Terms of Use

Article 1 (Purpose)

① The purpose of these terms is to stipulate the rights, duties, and responsibilities of Flitto Inc.. (hereinafter "the Company") and the personal location information holder, and other necessary matters with respect to the location information business or location-based service business that is provided by the Company.

② When the personal location information agent presses the "I agree" button of these terms, this shall imply that they have fully read and understand the content of these terms, and confirm and guarantee that they agree to the application of these terms to the Company.

Article 2 (Regulations Outside of Terms)

Matters that are not stipulated in these terms shall be determined in accordance with the Act on the Protection, Use, Etc. of Location Information, Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc., Telecommunications Basic Act, Telecommunications Business Act, and other relevant laws, the company's terms of use and privacy policy, and other guidelines that are set forth by the company.

Article 3 (Service Fees)

The Company shall not differentiate the Menu Translation service and charge separate fees for location-based services. However, there may be separate usage fees for the Menu Translation service that uses collected location information, and such fees such be in accordance with the Menu Translation terms of service use.

Article 4 (Service Content)

The company shall collect location information directly or receive location information from a location information business and provide the following location-based services.

  1. Mobile website service on the Menu Translation multilingual menu that shows the store's address and location information by using the personal location information holder or device's location information
  2. Other location-based services developed by the Company or other developersArticle 5 (Location Information Collection Method)

The Company collects location information through the GPS information that is collected through devices equipped with GPS features, location information through Wi-Fi information collected through devices equipped with GPS features, real-time location information based on base stations (Cell ID method) using mobile phone devices, or location information received through location information APIs that are provided by the electronic device's operating system (OS), such as a smartphone, tablet PC, etc.

Article 6 (Rights of the Personal Location Information Holder)

① The Company collects, uses, and shares location information as stipulated in the privacy policy, which is available for review at www.flitto.com.

② The personal location information holder can defer their agreement to the collection location information, purpose of using/providing personal location information, scope of recipients, and some location-based services by directly changing the settings of location-based services.

③ The Company must immediately discard the collected personal location information and other relevant usage records at the request of the personal location information holder

④ The personal location information holder can withdraw all or a portion of their consent to the collection/use/provision of location information at any time by directly changing the environmental settings on their device.

⑤ The personal location information agent can make a request to the Company to view or announce the following data, and they may request a correction in the event of an error in the data. In such cases, the Company shall not deny the request without a legitimate reason.

  1. Data that confirms the facts of collecting/using/providing location information regarding the personal location information holder
  2. Content and reason why the personal location information holder's personal location information was provided to 3rd parties in accordance with the regulations of the Act on the Protection, Use, Etc. of Location Information or other laws

⑥ The personal location information holder can make a request to the Company to temporarily stop the collection, use, or provision of their personal location information at any time, and the Company cannot deny this request and has the technical means to achieve this.

Article 7 (Basis for the Ownership of Data that Confirms the Facts of Location Information Usage/Provision and Ownership Period)

The company shall automatically record and save data that confirms the facts of collecting/using/providing location information regarding the personal location information holder in accordance with Article 16 (2) of the Act on the Protection, Use, Etc. of Location Information, and store the data for 6 months. If the personal location information holder cancels all or a portion of their consent to the use or provision of personal location information, the Company shall immediately discard data related to usage/provision of location information, except in cases where the information must be stored by law. However, if the personal location information holder only cancels a portion of consent, only the portion that is relevant to the cancellation shall be discarded. However, if the location information is included in posts that were posted by the personal location information holder, the information shall be stored for as long as that post is posted if there is no separate request to delete that post.

Article 8 (Changes to the Service or Suspension)

① If the Company is unable to maintain services due to the Company's general circumstances, such as a change in the position of the location information business or due to a legal disability, all or portion of the service may be restricted, changed, or suspended.

② If the service is suspended in accordance with the previous paragraph, the company shall make an announcement on the internet, etc. or notify the personal location information holder agent in advance.

Article 9 (Immediate Notification Upon Provision of Personal Location Information to 3rd Parties)

① The Company shall not provide the personal location information holder's personal location information to 3rd parties without their consent.

② If the Company provides services to 3rd parties, they shall notify the personal location information holder of the recipient, date and time of providing the information, and purpose of providing the information in advance and obtain their consent.

③ If the Company provides location information to 3rd parties in accordance with the Act on the Protection, Use, Etc. of Location Information, they shall have the personal location information holder choose whether they wish to be notified immediately or notified in batches, and notify them according to their selection.

④ The personal location information holder can request to view the content and reason why location information was provided to 3rd parties, notify, or correct errors in accordance with what is permitted by law.

Article 10 (Compensation for Damages)

① If the personal location information holder incurs damages due to the Company's violation of the regulations of Article 15 to 26 of the Act on the Protection, Use, Etc. of Location Information related to the location information business and location-based service provision, they may demand compensation for damages from the Company. In such cases, the Company shall not be exempt from liability if they cannot prove the lack of intent or negligence.

② If the Company incurs damages due to the personal location information holder's infringement of the regulations of these terms, the company may demand compensation for damages from the personal location information agent.

③ If the personal location information agent violates these terms through an illegal activity or by intention or negligence while using the service, which causes the Company to receive a claim for compensation for damages from a 3rd party aside from the personal location information holder, the personal location information holder must compensate the Company for the damages that were experienced as a result.

Article 11 (Dispute Mediation)

① If an agreement is not reached or cannot be reached between the Company and personal location information holder regarding a dispute regarding location information, a request for arbitration can be made to the Korea Communications Commission.

② If an agreement is not reached or cannot be reached between the Company and personal location information holder regarding a dispute regarding location information, a request for arbitration can be made to the Personal Information Dispute Mediation Committee in accordance with the Personal Information Protection Act.

Article 12 (Business Operator Information and Location Information Manager)

Article 13 (Rights of the Legal Representative)

If the Company intends on collecting/using or providing location information from a personal location information agent who is a minor under the age of 14 in accordance with the regulations of Article 18 Paragraph 1, Article 19 Paragraph 1 and 2, or Article 21 of the Act on the Protection, Use, Etc. of Location Information, the Company must receive consent from their legal representative. In such cases, the legal representative shall have all the rights of the personal location information agent from Article 6.

Article 14 (Rights of the Guardian of Children 8 Years of Age or Under)

① If the guardian of a personal who is subject to any of the following subparagraphs (hereafter "child 8 years of age or under") agrees to the collection/use or provision of the personal location information of a child 8 years of age or below in order to protect their life or physical body, the Company shall regard the guardian's consent as the child's consent.

  1. Child 8 years of age or under
  2. Adult guardian
  3. A person with a mental disorder in accordance with Article 2 Paragraph 2 Subparagraph 2 of the Act on Welfare of Persons with Disabilities, who is classified as a severely handicapped person in accordance with Article 2 Subparagraph 2 of the Act on the Employment Promotion and Vocational Rehabilitation of Persons with Disabilities (only those who are registered as handicapped individuals in accordance with Article 32 of the Act on Welfare of Persons with Disabilities)

② The legal guardian of a child 8 years of age or under in accordance with the regulations of Paragraph 1 refers to the person who actually protects the child 8 years of age or under and is subject to any of the following subparagraphs.

  1. Legal representative of a child 8 years of age or under or a guardian in accordance with the Act on the Guardianship of Orphans in Protective Facilities
  2. Legal representative of an adult guardian
  3. The legal representative of the individual from Paragraph 1 to 3, head of a residential facility for handicapped individuals in accordance with Article 58 Paragraph 1 Subparagraph 1 of the Act on Welfare of Persons with Disabilities (only facilities that are set up and operated by the government or local government), head of a social rehabilitation center for persons with mental disorders in accordance with the regulations of Article 3 Subparagraph 4 of the Mental Health Act (only facilities that are set up and operated by the government or local government), or the head of a mental health care facility in accordance with Article 3 Subparagraph 5 of the Mental Health Act

③ When the legal guardian gives consent in accordance with the regulations of Paragraph 1, they must attach documents that verify that they are the legal guardian to the signed consent form and submit them  to the Company.

④ The regulations of Article 6 (Rights of the Personal Location Information Agent) are applicable when the legal guardian gives consent in accordance with Paragraph 1. In such cases, the "personal location information agent" shall be regarded as the "legal guardian".

Article 15 (Indemnification)

① If the Company is unable to provide services due to the cases in the following subparagraphs, they shall not be required to take responsibility for damages that occur to the personal location information agent.

  1. Natural or other similar cases of force majeure
  2. If there is intentional service disruption by a 3rd party with a service partnership agreement with the Company to provide services
  3. If there is a problem with service use due to reasons that are attributable to the personal location information agent
  4. Other cases aside from Subparagraph 1 to 3 where there was no intention or negligence by the Company

② The Company does not guarantee the service or information, data, reliability of facts, or accuracy, etc. of information posted on the service, and shall not be held responsible for any damage suffered by the personal location information agent as a result of this information.

Supplementary Provisions

These terms shall take effect starting January 1, 2021. However, new members who registered prior to the effective date after the announcement of these terms shall be subject to these terms starting from their membership registration date in spite of the previous clause.
